Unjustified confiscation of legitimate winnings

I opened an account with Stay Bet, getting a 100% bonus of 100 Euros. I played thru the roll-over requirements, constantly monitoring the remaining required roll-over amount, and converting all bonus money to cash.

I continued to place bets and submitted a withdrawal request. After spending a couple of weeks back-and-firth, submitting and re-submitting various IDs to get my account verified, I received a response from Stay Bet stating that all monies in my account (almost 600 Euros) had been removed other than my initial 100 Euro deposit, as I had failed to roll-over the monies required.

I asked why the running total visible in my account displayed info showing that I had met the rollover requirements and why, even if I had not completed the roll-over (although I was under the impression that I had due to information displayed on my account) should all my funds be taken from me when my account, just prior to roll-over completion, stated that I had approximately 200 Euros of bonus money and the rest of the balance in cash?

The response was that all bets were registered against the roll-over target on the site even if they didn’t count – I replied again saying this was deliberately deceptive. I was also told that all monies are tied to the bonus, again even though this was not what was shown in my account.

I replied that I will publicize this case across social media should I not receive back the money that was sitting in my account for over a week, prior to my attempt to actually withdraw it. When I next checked my balance had risen from 100 to 144 Euros – not quite the 500-pus it was a couple of days ago.

AskGamblers Complaints Team have been provided with valid evidence on behalf the management of Staybet Casino where it is clearly displayed that player has placed bets higher then allowed, and also played casino slots with the sports bonus. Player by these actions breached the Staybet Casino term #XII.4:

"The Maximum allowed casino bet when wagering is €5 each bet or the equivalent in other currency per game and spin and €25 per sport bet coupon (For all terms, see sport bonus section). Larger bets will lead to confiscation of the bonus assets, free spins and possible winnings made on bonus money.

When fullfilling the wagering requirement, the €5 casino max bet rule and €25 max sport bet rule still applies up until all funds from the wagered bonus has been withdrawn, since these funds originate from the bonus.

You must also wager the bonus in the product you claimed the bonus for, therefore you are not allowed to play for example casino with the sport bonus or sport with casino bonus. These rules also apply to campaigns that by mistake were promoted without a valid wagering requirement."

Based on the above, AskGamblers Complaints Team consider this case as Resolved and it is now officially closed. In case of a disagreement with our decision we remind player that further assistance on this matter could be requested from the relevant licensing authority responsible for Staybet Casino.

Hi there - I had a balance of 590 Euros (almost 600?), including the deposit and screen shots to prove that. Also I have a transcript from an instant chat with your support team stating that 'all sports bets count towards the rollover requirements of the welcome bonus'.

And as previously, my main query is why did the bonus section of the site show my rollover requirement reduce if bets made were not valid towards it? Ultimately it showed that all roll-over requirements were met and it was not until I made a withdrawal that you then decided that in fact, I had not met the requirements.

Hello Heshypunk,

As you have previously been informed by us the reason for confiscating your balance was because you broke multiple betting rules while wagering a bonus. The confiscated amount was not “almost 600 euros” it was 440 euros and the following terms was breached.

“the maximum allowed casino bet when wagering is €5 each bet or the equivalent in other currency per game and spin and €25 per sport bet coupon. Larger bets will lead to confiscation of the bonus assets, free spins and possible winnings made with bonus money.”

“the €5 euro max bet rule and €25 max sport bet rule still applies up until all funds from the wagered bonus has been withdrawn, Since these funds originate from the bonus”

And if this was not enough you also played casino slot games with the sportsbonus.

“You must also wager the bonus in the in the product you claimed the bonus for, therefore you are not allowed to play for example casino with the sport bonus or sport with casino bonus.”

As it seems you broke almost every betting rule there is and we have no other choise then to confiscate the winnings won with bonus money (€440). Your deposit of €100 was reinstated in your account.

Hello! I am stil waiting for payment after now 36 days. On March 14th I requested a withdrawal for 6,900 SEK. After about 3-4 days I asked support if something was wrong and they told me that it wouldn't be processed and I had to wait until it returned to my account and then request another withdrawal. So I made a request for 6,000 (lost 900) and after about 3-4 days nothing had happened again. I asked the chat and he (David) told me it says it is pending but in reality it does nothing at all. Some bug he said. So again it returned to my account. If I hadn't asked why nothing had happened it would probably still be "pending" (doing nothing at all). However, I had to ask them to cancel in order to make a third withdrawal. After 3 days (and a few mails and chats) the money returned... I now made three withdrawals, trying some other "tactics" or whatever. They were for 5,000, and 600 (I lost 400). I lasked them the same day to cancel the 600 due to tilt... It returned 2 days later and i lost them. So 5,000 remaining. That one was pending for about 4-5 days before I asked them to cancel it. Again it till several days for the money to return. I decided to try this "one big-one small" - "tactics" again. So I made requested for the fourth time... Now for 4,000 and 1,000. I didn't have much hope because during all these weeks they claimed they had a lot to do and I had to wait for my turn, they had technichal issues, their partner responsible for withdrawals had problems, they are changing platform and so on. However, they told me every now and then that it would be procesed during the day day and sometimes that it was resolved and I would expect a payment. Nothing happened for 3-4 weeks up to that point, so I was chocked when I saw that the withdrawal for 1,000 no longer was pending. 4 days later it was banked. What is weird with this, is that the other request for 4,000 (that I made simultanuesly) never was processed. I checked the day after, and nothing was pending. So I thought they finally paid in full. However, the day after that the 4,000 was back as pending status. It has been like that for almost two weeks and the last thing I heard from them was Friday 13th when they told me their IT-group for their backoffice worked on the technical issues. That same day I noticed they have a new starting page. However, now I can't egen log in. It says "UserNotFoundException". Live chat doesn't work almost no games in demo mode works, forget password doesn't work and so on. And no info anywhere. I have mailed every day now any without response. I get the auto mails but they never reply. Is the site down? Bankrupt? Are they simply ignoring me forever now, blocked me from the account? Or is it actual tech problems that will be resolved? Today it has been 36 days in total. Will I ever get the money?
