FortuneJack Affiliates - Refusal to Pay Affiliate Commissions

RESOLVED

I have been interacting with FortuneJack for several weeks now about being paid for my affiliate commissions. My referral also has been emailing them about this and they have disregarded us both. They are totally refusing paying me my commissions at this point. They have been delaying and stringing me along now for weeks. And I have been countless hours dealing with this. I just want paid for the revenue I am responsible for bringing in.

Their objection is that the Player referral in question is not listed under my affiliate account as my sign up. That’s true, but the reason that they aren’t listed under me is due to a technical error where the referral was not assigned to my affiliate account. This sign up happened in September of 2017 originally. Their backend affiliate dashboard at that time was very misleading and confusing. (See attachment) The result was that my players weren’t being assigned to me. The reason how I know that my player did sign up, is because this particular player I know locally, and I physically assisted her in the sign up process. Otherwise, I would have no idea, and I still have no idea how many more players signed up because of me. There are probably several others. Although, I am not pursuing these commissions. Fortunejack was Aware of the confusion with their layout because they have since changed their affiliate dashboard to make things much more comprehensible, which is a recognition that the problem existed. Yet despite their recognition, acknowledgement, and subsequent modification of their system issue, they have still refused to pay me my rightfully earned commissions. My referring Player has also been informed them of the issue and informed them I was her affiliate and she has been correponding via email, livechat, and Skype in addition to my conversations. I have documentation of all conversations and account balances and screenshots of everything. I will attach only the few most important to make my case but if requested I will upload every word and number that was spoken, posted, or otherwise transmitted.

Basically I just want to be paid the commissions that rightfully deserves. I have actually done the math in those commissions (50% for September and 20% for October).

The total commissions owed to me for September and October:

1.61 LTC
.1039 BTC

This is the sum of both months commission.
This is the total I am disputing and requesting payment of both. This complaint does not even mention the month of November because at this point i have chosen to no longer Pursue the commissions and just want my pay for those two months. Then I will move on my way. But there are even more unpaid commissions but I agree to not pursue those if this is resolved properly.

I used the formula (total deposits - total withdraws - any current balance = monthly gaming revenue * commission percentage)

October deposits: (20% commission)
.4932 Bitcoin
2.54 Litecoin

Seltember Deposits: (50% commision)
.26 Bitcoin
1.71 Litecoin

First I deducted any withdraws that my one player made and any current balance (0). Then I multiplied by the agreed percent for that month. In September I was receiving and introductory commission promo so for those deposits it was 50%. In October the intro promo was completed so commissions were only 20% for that month.

My player referral will also be filing a complaint because she has been defending me and demanding I be paid commissions as well and they have been making excuses to her as well.

Fair is fair. And that’s all we are asking for. Nothing more. Nothing less.

Fortunejack is a “probably fair” casino. Well, we had an affiliate agreement and both Fortunejack and I, agreed the terms of this agreement were fair. I brought in revenue and fulfilled my end of the terms. Now comes their end and are refusing to fulfill theirs. So which is it FortuneJack?

You say that it is Provably Fair.

Well, Fair would be to pay me the commissions from the revenue I brought in.

Now we both know that’s fair. But you don’t want to pay me anyways. Nonpayment. Is that probably fair?

Now is your time to prove it to all AskGamblers Players and community reading this complaint.

By making my commissions payment or refusing to do. Time to prove it.
I will update you all with the Final determination as to whether I was paid or not.

This is the misleading element of their affiliate dashboard. It states referral link right next to s URL which is not actually your individual referral link. Everything alludes to this being your individual referral link but this simply is not the case.

Here are several of my attempts to reach out and rectify the issue by requesting my proper commissions payments. As you can see I was met with continuous delays and stalling tactics. This is very frustrating because every time I would speak with their associate we would have to start over from the beginning of the story because she would seem like she had no idea what I was talking about. She was always very nice and professional I must say that. But the issue was never resolved obviously.

And lastly here is the conversation where Nina had indicated that they couldn’t pay me “yet” because it was not the 5th of the month. She stated that I would be paid on the 5th of November but then that day came and went and I never received any payments at all. Again, very frustrating and confusing as to why they would do that to me. I have been a player at fortune Jack since only a few months after they opened. I joined in 2015. And have always been there for them to make deposits and build their bankroll. So why can they not return the favor when I helped them and worked to generate revenue on thei behalf. Very confusing approach once again. 😕

Hi Dear DAWGPOUND,

David here, a community manager for FortuneJack. I think you have already received an email from Max, our ace pilot of customer service, but we haven't received a response yet, so let me post our comment here as well.

I think this whole thing is a huge misunderstanding and from our side, let me apologise if anything in past communications was unclear and led you to wrongly understand the terms and conditions of the affiliate program. You have agreed to a chat with our Affiliate Manager, that you were not using referral links correctly, which you admit in skype conversation screenshot of which is provided as an attachment of this post.

As this vital part of the affiliate, an agreement wasn't fulfiled, our hands are tied to deposit funds on your account, which according to the system you haven't earned. But we totally understand that life, business and especially our relationship is much more than what system states, yet we have to follow established rules to keep it professional.

However, we totally understand your position and agree that this may have happened to anyone. So please, let's move it to the new page, you have already been instructed by our Affiliate Manager how to use the service correctly in future. From our side, as a compensation, we are happy to double your affiliate percentage for the next 3 Months up to 40%.

Again, sincerely sorry this little misunderstanding happened, but let's move forward with the new deal and new motivation to earn more with our affiliate program.

Cheers.

David,
First off, you are right that I received an email from Max, which I responded to right away. To say you haven’t received any response, Is simply untrue, which I have come to expect from FortuneJack agents. At the very minimum it speaks to the poor communication between your own parties. Max received my response, which much like your response, seeks to passive-aggressively shift responsibility of this incident purely onto my shoulders when we know that simply is not the case. First off, this issue has been dragging out since mid October. Your staff has given me the same generic responses and avoided this situation for over a month before I finally filed this complaint and suddenly now there are all these managers here to help.

Secondly I fundamentally disagree with your assertion that this is the result of my misunderstanding of the terms and conditions within your affiliate program. That implication is offense and takes no accountability on your behalf. The fact is, you all had a dashboard that was deliberately confusing so that when your affiliates signed up referrals they wouldn’t actually be credited to their affiliate accounts and this enables you to subsequently hide behind the terms and conditions and blame your affiliates for being incompetent in your attempts to avoid paying them- exactly how you have done here on this thread with me. You all have even changed the entire design of your dash and fixed the errors which I have pointed out throughout my post. The fact that you fixed this poor layout and design and released and entirely new layout indicates that you all also saw the same problems I did and eventually moved to correct this problems. You have refused to correct the financial implications that these problems. The bottom line is that I worked to generate fortunejack revenue and I did just that. I generated significant revenue through my Player. Due to this technical error which was a result of your flawed layout and design (not my misunderstanding of the terms and conditions) you all are refusing to pay me any commissions despite your acknowledgement that the site was flawed, and your acknowledgement that the player was referred by me, and your own affiliate manager told me I would be paid on the fifth of November and this, like many other things I have been told by your staff, was a downright lie!

Let me make clear that I have no desires or intentions of continuing my affiliate work with fortunejack. The treatment I have received behind the scenes has been quite very troubling and has full of misleading and downright false representations which are in stark contrast to your insincere response. The bottom line is you are refusing to pay your affiliate for the revenue they have generated. I have been with fortunejack since shortly after the opened the site signing up in 2015 and to receive this type of treatment after the 10 or so bitcoins I have desposited and then the countless hours working to refer players and help your site grow - only to then be slapped in the face by your staff and strung along with a series of lies and delays, is simply unacceptable and so is your offer of higher commissions moving forward.
I will not do any more affiliate work until I am paid for the work I have already done. I am not a slave and that notion that I should work for free would be considered a violation of the Geneva convention’s definition of human rights. I am a human being with a family and who deserves to be paid for their work. You all’s greed and arrogance is seething throughout the numerous responses your staff has given me. Up until now you have made no attempts at resolving this issues. I am not a slave of fortunejack and I do not want to continue my affiliate work until I am paid for the work I have successfully completed. Only then can we continue on with a new day and a new chapter. I have lost all trust in fortunejack. You have told me countless lies and put me through hell just to attempt to receive my commissions.
I am a very reasonable individual but your offer and attempts to weasel your way out of paying me any commissions for my work are objectionable and offensive. Your affiliate
Manager had already stated that I would be paid on November 5th which I have posted on this thread. Here we are on November 22nd and I have not received any commissions payments. I once again restate my request for payment of the 1.61 Litcoins and .1039 Bitcoins that results from the revenue I have already generated. Thank you for your response but it lacks several things including: an accurate portrayal of the circumstances, a truthful account of the treatment I have received, accountability for your errors and technical problems, and lastly - payment for my commissions.
Also worth noting this is not the first technical problem fortunejack has had. They just came off of a month long delay where they were having technical problems with their bonus system and they withheld users funds for several weeks without any proper explanation and a series of generic responses and delays exactly how they have done here with me. Your players and your affiliates deserve much better than the treatment and respect you all are giving us and I deserve to be paid for the income that I have generated.
Awaiting your response and my commissions payments. Regards.

Hi DAWGPOUND,

First of all, let me apologise for the delay in treating your case and miscommunication that took part in our management and affected you, dear user. Miscommunication is a severe problem, I agree, this is due to recent movements inside our team, it takes some time to become a real team, and I can assure you, we are on the way.

Because we are on the same page in lots of cases, like yours. Moreover, we all agree that despite our sympathy towards you as a player, as an affiliate and as a human being, we can not make an exception when we do not cause the case, but misunderstanding and misuse of our system. You have agreed in emails and in this posts that you have not been using the system correctly and frankly, there is nothing we can do now. We highly value your contribution, and that is why we double your rates for future three months, we give you deal none of any other affiliates will get now.

Despite our efforts to somehow negotiate with you, explain the causes and even conduct individual explanation video calls of how to use system correctly (when by the way our manager worked over hours just because of time difference between your location and our office), you used all this communication and case to make a storm in a teacup and started speculative trading over your askgambler complaint. I will provide the last mail we received from you in the screenshot, where you propose your terms.

Dear user, I can tell you that this is not the way business is done in FortuneJack, we believe in fair and transparent negotiation and resolving of cases, that is why we approached you both in public and private conversations. However, here my sympathy towards you speaks, and I still offer you the rationally resolve this case, leave the speculative talks about GENEVA CONVENTION (here I have to admit that I am shocked with mentioning this document. This is a grave legal accusation and you may have to stand for it.) and get back to the table.

We still offer you the deal for future three months. The money you are requesting cannot entirely be tracked, and there is not a technological or legal way for us or even for you to validate it. To speak directly, you have come up with the sum and now are negotiating it in a very speculative passion, which is a shock for us firstly, and secondly, we can not technically issue, giveaway or deposit funds we can not track and validate in our system.

Cheers.

Fortunejack has refused to pay me for my affiliate referrals and affiliate marketing work. The complaint should remain open and unfulfilled until I am compensated. This is not about speculative trading. It was about my desires to severe ties with your company and my willingness to compromise in order to reach an agreeable solution. It seems more than apparent that “compromise” is not a word in Fortunejacks dialect. Management is clueless about customer Service and how issues should be handled. You will see more and more complaints sprouting up with their names on it as you simply cannot run a business with the carelessness towards their players and partners. It is catching up with them as we can see with the number of poor reviews and online complaints littered across the internet. Plenty of better affiliate options 💰💰out there. These guys will ☹️ 💸

Dear User.

Email with following content has been sent to Askgambler's managing group and we are posting here it as well.

First, let me state that our platform- ParnerMatrix, which the user is blaming the whole mishap, is a leading iGaming Affiliate Platform - that is extremely user-friendly and intuitive. Also, I must state or emphasize that we have never received a complaint blaming the platform for trying to deceive our partners. We pride ourself on being partner-oriented, and for that reason, we chose this platform to make sure you have all the tools needed to generate revenue efficiently.

I am attaching the screenshots, of the specific player, which claims to be our affiliate for two years. We migrated the whole system back in June. I am attaching screenshots where the DawgPound21's platform shows 0 in every part such as :

- Signups
- Commissions
- Activity Reports
- Revenue, etc.

The reason is that when you want to track players, in case of the referral link (see the first screenshot), you should press the "Get Code" button from the right side of the dashboard, after what you receive a Btag tracker like this - https://tracker-pm2.fortunejackpartners.com/link?btag=866577_42941. This tracker is used to track the clicks and sign-ups. The same way for banners, and other media sources. Once you receive the Btag, the Inactive media turns into green, and it means it is active and up and running.

You reached out to us at the beginning of October, when it was our new affiliate managers first week at FJ, complaining that you are not getting paid the commissions. The manager immediately asked to set up a Skype call with our tech team so we can find out what is the issue. It could have been our platform, but until we were sure, we couldn't say anything. The affiliate completely ignored the offer (see screenshots attached) despite us trying to help him out after usual working hours. As you will see in the attached screenshot, the affiliate never had payments even before September, and the payment history is empty.

To make the story even more clear - the affiliate did not use the Btags needed to track signups and commissions. Sometime in October, he realized that he was not getting any commissions and reached out us - bringing numbers that are not firmed by any evidence and asking to get paid for an amount that does not exist. We offered the user double commissions and also showed how the platform operates, and he still refuses to accept the offer and continues to trash our platform. Once again, I would like to emphasize that we will not pay the user the money that is not tracked. However, we are showing willingness for a fresh start and offered 40% of rev share instead of 20% (double amount for next three months). Please have a look and let me know if you need any additional information.

Please update us in case of acceptance of new terms, which is a huge exception in this kind of cases.

Thank you.
