Gypsy Affiliates - Gypsy affiliates does not pay our commission

RESOLVED

We have a problem with Gypsy aff. since february. We had CPA deal with them and they are not paying.

Our payout should be: 42100€. < full name removed > (our affiliate manager) has told us that their antifraud team is checking the players. We understand that is normal procedure. But it should not last 2 months. Normally this should only take a week.

We would like to publicate this matter as they keep dodging us and reply with same meaningless answer when we ask for our commission.

I'm attaching tons of screenshots where she claimed that our traffic is being checked and this matter will be resolved soon. Every time we asked she replied tomorrow.

Please help us regarding this matter.

Dear AskGamblers team and Britex,

Providing our comment to this situation, we would like to emphasise that same as everyone in this business, we are looking for true partnership, which is mutual for both sides - but not one-sided way of cooperation.

Let us refer to our Terms and Conditions, please, according to which we, as an Operator, have the right to start traffic check procedure in case any players bring us concerns (paras. 6.11. and 8.8.).

132 players can not be qualified in accordance to the paragraph 8.4.:
8.4. A CPA is paid to an affiliate for each player whose bet amount at least equals the amount of the established CPA or the equivalent in other currencies, if the transaction does not have additional conditions such as baseline or others.
https://prnt.sc/RqNzwAyc7Rw6

And if we refer to Britex’ statistics by player, these 132 players mentioned above, have made bets for amounts lower than CPA deal he had (all data is sent to administration).

Furthermore, 29 players were not qualified due to the reason of suspicious activity that has been detected during the players’ analysis by the anti-fraud department of platform provider.
T&C, para 8.1. All the traffic that our partners have provided to us passes anti-fraud system and, based on this, we pay a commission only for high-quality traffic, otherwise we reserve the right to reject it. We entitled don’t disclose the algorithms of our anti-fraud system. https://prnt.sc/ZVWHC2HkRtQ3

Moreover, 5 players have Self-excluded status, 9 players have Closed/Disabled status - which also makes them non-qualified in accordance to T&C paragraph 8.6.: CPA part is not calculated and not paid for players which have “self-excluded” & “cooling off” statuses.

6 players are not qualified due to the fact they are duplicate players, and according to Terms and Conditions paragraph 8.5., CPA part is not calculated and not paid for duplicate players (e.g. in case a player has already an account).

In total, the commission amount has been amended for 155 players.

We’d like to mention that partner has already been paid an amount of 46200 EUR for Bitvegas before. Thus, we don’t have a debt to Britex.

All the calculations and corrections have been done within Terms & Conditions of our Affiliate Program.

Based on all the above, a deal of 50% Revenue Share has been set since the 1st of April 2023: to be applied to all the existing players in case they continue playing, and to the new FTDs if such appear due to late conversions.

Kind regards,
Gypsy Affiliates team

Dear AskGamblers team and Gypsy Affiliates,

We would like to express that for the partnership to be profitable for both sides each of the partners have to do their part. We have done our part and sent quality traffic to the casinos. Proof of this can be seen in the statistics sheet that we are attaching (deposit sum is more than our commission and NGR is close). Also we have sent the same traffic to multiple other casinos and have not received any complaints. It is clear for us that the CS team of casinos have not pushed the players and the overall quality of casinos was not sufficient for the player value to increase.

Let’s talk about the “Terms and Conditions” you have brought up.

Firstly about paragraph 8.4. This seems like a shady business practice and does not fit into the deal we have discussed. In multiple instances during negotiations we have agreed that the deal has no baseline (attaching the deal). You can bring this paragraph up against any partner that you don’t want to pay the commission. This paragraph simply says that you have power to increase the baseline to CPA amount any time you want, which is inadequate. This is a CPA deal at the end of the day. Plus, even if our players were not qualified due to paragraph 8.4 why did it take you 2 months to tell it to us? Not to mention that we have been working with Gypsy for more than a year and this paragraph has never been brought up. In conclusion paragraph 8.4 awfully seems like newly added to your T&C and does not make any sense.

About paragraph 8.1. Again this seems like a shady business practice. You can flag any players as “suspicious” and don’t disclose the reason why they have been flagged. The reason for the exclusion of 29 players is not clear to us. Interesting thing is that not all of our players have been flagged.

At this point we would like to kindly request the AskGamblers team to take a look at Gypsy Affiliates’ T&C and see if it has anything suspicious that we are not informed about yet. We have read the T&C when we started the partnership but such paragraphs did not catch our eye. But unfortunately we did not take any notes back in the day, hence we can’t make any accusations about variation of T&C. But surely if we were informed about the said paragraphs we would have declined the partnership.

“5 players have Self-excluded status, 9 players have Closed/Disabled status, 6 players are not qualified due to the fact they are duplicate players” - We have seen such cases with all of our partners and the number of players excluded by such reasons seems reasonable.

We don’t consider any rev-share deals at the moment and we have never consented to the rev-share deal Gypsy Affiliates have set.

Regards,
Britex team.
