Player Used a Bot, Casino Refunded. Any Advise?

Im not desperate, and dont even know is it worth to do.

Just wanna know your opinion

 

I played on StanJames poker, lost some money on poker.

 

And got email from them :

 

As part of our robust security measures, we identified a player who was found to be using "bot"software in the previous month in some of the games you have played. We have seized funds from the player's account and will be crediting your poker accounts with a total of €5 (USD equivalent) on Tuesday  15th August at around 12:00 BST.

The casino have responsibility to provide safe and secure conditions to play. As this letter prooves, there was breach of security and safety, which means they breached they agreement, there for should refund all loses to myself.

The way I see it, as how the law would work, the casino's responsibility only applies to all the software that they provide in their casino. In the case you mentioned, another player was using a bot software to play his poker games. This player had committed a breach of the rules, not the casino. The casino's responsibility is to catch any player using any prohibited software or other unlawful means, including collusion, and to confiscate all winnings from that player. The casino has done this, and is paying back all the affected players some refund...the amount refunded being at the discretion of the casino's management.

 

The way I see it, you cannot blame the casino for what had happened. In fact, the casino is kind enough to refund you some of your lost money!  ;)

Im sure the casino has a disclaimer to something like this in their t's and c's. 

 

All boils down to what they reasonably could have expected to have in place in terms of their security. Just because there was a breach doesn't necessarily mean they were negligent. 

 

Having said that it's an interesting point - if you could tie losses back to the bot then could argue that they had a duty of care, they broke it and as a result you suffered a loss. BUT it is gambling and special points around the law wouldn't follow this typical 'negligence' and financial loss criteria.

 

Maybe someone from a licensing authority would have more detail/expertise.
