Unfair confiscation of all winnings

On 3th October I have won 11755.30 Euro at Magical Spin Casino. I have only played slots and roulette and I have not used a bonus.

However the casino wants to confiscate my winnings and their reason for confiscating my winnings is that I have increased my bet size in roulette with each spin and therefore I would have had an advantage.

I have received three emails from them. On 6th October I have received this email:

7.4 The use of automated mathematical techniques which do not give place to chance, especially roulette games, is not permitted and may be considered a fraud or cheating technique.

Therefore, and as per our general terms and conditions, the last session is canceled and so your full balance is canceled too.

You can make it public, this is a mathematical technique and it is strictly forbidden by the general terms and conditions you accepted.

To explain you : on every spin, with this mathematical technique, you have a probability of winnings by 1/9, so after 9 spins you are almost sure you are going to win. By adding 100 euros on every spin you make sure that after 9 spins the winnings will be higher than the money wagered. So, it is an unfair advantage and it is a fraud.

For example, with your method :
After 9 spins you would bet 10.350 euros (750+8­50+­950­+10­50+­115­0+1­250­+13­50+­145­0+1­550), for winnings of (on the 9th spin) 13.950 euros.

As you can see, you are almost sure that you are going to win money with this method.

All I did was increasing the bet size on 4 numbers in roulette with each spin. They believe this is some kind of roulette system and they believe I would have had an advantage because of this which is absurd. Roulette always has a house edge of 2.7% regardless of the bet size.

Again, I have only played with my own money, I have not used any bonus money! Furthermore less than half of my winnings came from playing roulette, the rest of the winnings (about 7000€) came from playing slots and yet they are confiscating all of my winnings and not only the winnings from playing roulette.

Recently they used this term from their T&C to justify the confiscation of my winnings:

When a game session is performed without using a bonus, it is prohibited to bet (sum of individual bets within a round) more than ten times the amount of the deposit of the session. In such cases, the entire session is automatically canceled.

The T&C say "game session" and not "play session"! Nowhere in the T&C it is defined what "game session" means, but from my understanding it means the time between starting and exiting a single game. In this case only the winnings from my roulette session can be voided and not the winnings from other game sessions I had, because except in roulette I never bet more than 10 times my deposit. It is still unfair, because I'm sure if I had lost my entire balance while playing roulette they would have not cancelled the roulette session and restored my balance that I had before playing roulette.

In my opinion if they would have meant the time between making a deposit and requesting a withdrawal then they should have used the word "play session" because that would unambiguously refer to the entire playing session.

They should at least pay the balance I had before playing roulette which was about 7000€. I think it is still unfair to not pay my roulette winnings but they should at least pay my other winnings.

AskGamblers Complaints Team do not consider that breach of the term #7.4 has been justified enough, unlike the breach of the term #7.6 which has been proven with the sufficient evidences, where it is clearly displayed that the player placed single bets in amount higher then ten times the amount of the initial deposit, in multiple occasions. The player by that act violated casino term #7.6:

7.6  When a game session is performed without using a bonus, it is prohibited to bet a single bet more than ten times the amount of the initial deposit. In such cases, the entire session is automatically canceled.
For example:
A player who deposited €100 can't perform a single bet over € 1000.

Based on the above, AskGamblers Complaints Team consider this case as Resolved and it is now officially closed. In case of a disagreement with our decision we remind player that further assistance on this matter could be requested from the relevant licensing authority responsible for Magical Spin Casino.

As explained previously, we are always doing everything possible to provide the best services and proper assistance and at the same time, we always stick to our General Terms and Conditions and do not tolerate any kind of its violation.

As you explained on your complaint, we actually told you that you breached 2 rules of our T&C, the rule 7.4 and 7.6.

We explained you what we consider as a violation for the rule 7.4, and we will now explain you our findings of the term 7.6 breach.

Please find the rule 7.6 of our T&C :

"7.6 When a game session is performed without using a bonus, it is prohibited to bet a single bet more than ten times the amount of the initial deposit. In such cases, the entire session is automatically canceled.
For example:
A player who deposited €100 can't perform a single bet over € 1000."

Unfortunately, after several verifications, it appears that you placed several overbets : 670 euros, 750 euros, 850 euros, 950 euros, 1.050 euros. Since you deposited, on the beginning of the session, 50 euros, you were not authorized to bet more than 500 euros / spin.
For your information, the exact definition of "game session" is explained on the very beginning of the T&C :

"- The user is aware that User can lose money by making a bet during a game session. The term "game session" means all the activity (bets and winnings) from a deposit until both bonus and/or real balances are under € 1 and without any withdrawal request winnings derived from this deposit."

Therefore, you did not respect the rule 7.6 of the T&C you accepted and the fraud and verification team was in their rights to cancel the full bonus and real money balance as explained on the rule 7.7 :

"7.7 If Magical Spin or Betrust Entertainment B.V realizes that a User has violated one of the conditions above or any other terms and condition of this contract, the Casino can opt for one or more of the following :

- Full bonus balance and real money balance cancellation.
- Cancellation of the full the session.
- Retention of the user's winnings obtained in this session.
- Closing the user's account."

All the proofs of the violation of the T&C has been provided to AskGamblers Complaints team.

AskGamblers Complaints Team have been contacted by Magical Spin Casino representative and we were provided with additional information regarding the complaint. Unfortunately, we reached to the decision that the provided information and evidence were definitely not solid enough to justify the actions which Magical Spin Casino applied against the complainant and additional information and proofs have been requested as follows:  

1/ The relevant of Magical Spin casino/bonus term/s which could justify their actions against the player. 
2/ Proof that the betting system used by the player could/should be considered as some sort of a ''roulette system'' which is forbidden by Magical Spin Casino terms. 
3/ Proof from the relevant software vendor which is supplying their brand with the disputed game that the aforementioned ''roulette system'' would bring any mathematical advantage if used. 
4/ Detailed explanation and proofs if any which could justify Magical Spin decision to confiscate ALL funds rather than only the funds used by player to fund their so called ''roulette system''.

Refuses a withdrawal without any notification

Hello @AskGamblers,

I've had a terrible experience with the Magical Spin casino.

I've had a pending withdrawal since 11.08.2023 after I completed a wager of 7500 EUR and decided to withdraw my winnings of 2000 EUR. I've reviewed all their policies and there's no written processing time frame for withdrawals. I've followed all rules and have not gone over the maximum bet of 7.5 EUR.

The chat support is not helpful, they only said to contact [email protected]. I've done this for the past week (several times). They do not reply at all. The chat said on Tuesday that the payment will be processed this week. But it was cancelled yesterday, without even notifying me why it is cancelled, is there any issue or what is the case?

The funds are credited back and now the chat support says next week the processing will happen but they cannot confirm anything and to contact the Finance department again. I've done this but they don't reply and do not provide any specific processing time frame. So the payment is again pending without any idea when it will be processed.

This is a horrible experience as you don't get any answer. The chat is referring you to a non-responsive mailbox. I've sent several emails over the past week. My experience with other casinos (who process payments during working days) is that you won't wait more than 2-3 days to get a payment, or if it is more (technical issue, verification issue etc.) they will provide any solid explanation and give a proper time-frame. Here, this is not the case. May payment was pending for 6 calendar days and just got cancelled without any information - no email, no message, nothing. If I did not log in to check, I would have no idea. My account has already been verified but I contacted the Verification team on 11.08.2023 just to make sure it is fine and the payment is not pending for additional verification. I've not heard anything back from them as well since last Friday.

I am a patient person but haven't heard anything from the team processing the payments, no solid information on their site (policies) regarding processing time-frames, which is what makes me raise this complaint. As my winnings are basically locked on their site and they do not help in any way to understand what I could expect and when. I've attached files confirming the cancelled payments (with no notification), the new ones, payment history etc. (private).

Please review this complaint and help me get this resolved.
